Go look at how "interest" is definded in the documents. In the docs for Maui and Tahoe, it is clearly isolated to those specific resorts. We'll bet that if you follow the trail far enough it will probably isloate it to a single resort. Along with the ability to make reservations, "interests" are granted membership in the HOA and the right to vote. I've followed the entire route including definitions, rules and regulations, bylaws, etc and I stand by my interpretation. But as I stated on Hoc's thread about Vail, if you have to go to inferences to make a point to change the interpretation, you're on shaking ground already. As a rule the legal documents say what they mean so having to prove something round about that's different than the system's interpretation is difficult to impossible. That's not to say it can't be done, I've seen it done with DVC on a couple of occasions.

After having been here a little over a year, I'm amazed by two things:1. How much more the average TUG'er knows about timesharing than the average timeshare owner. 2. How often TUG'ers forget #1. Having observed this debate, and knowing the legal language in our documents matches that promulgated by Dave and Trina, I've come to the following conclusion: Milk Marriott for all we can get. They charge us a pretty penny for our vacations. Let their lawyers worry about catching us "interpreting" the rules... Over and out  Pat IP: Logged | |
