I realize that this information was posted just a month or so ago, but it was on the old board and no longer available. I am soon to be in the process of purchasing a t/s from an individual (I was just notified that I won an auction). I would like those of you who have bought & sold weeks to suggest companies to handle the paperwork, just in case the seller does not have this information.

Hi, Rod!

Don't know about companies, but we just sold ours with the do-it-yourself kit sold by Timesharing Today. It is very complete, and has all documents from the purchase and sales contract (including points, if applicable), to loan agreements (if needed), and sample letters to send to the buyer, the resort, etc. It costs $25, but you can download it at their website at www.tstoday.com, and if you download instead of having them send you a hard copy, it only costs $21.99.

I should point out, however, that these documents are customarily the obligation of the seller.

Because the property was not very expensive, the buyer opted not to have a title search done.

I prepared the deed myself. First logged onto the website for the county registry, and it tells you exactly what requirements to fulfill to make the deed legal. I used the deed that I had for the property, verbatim, as a model, making sure I had the proper, required information, such as the legal description, buyer's name and address, etc. and left the requisite room for the county to apply its recording stamp (they tell you on the website how much room and where on the deed it needs to be). Then, had the document notarized and witnessed by two people.

The buyer trusted me enough to send me the cashier's cheque, and I sent, via the Postal Service Express Mail (supposed to be next day delivery, but it arrived two days later - got a full refund, though...) the completed deed, and the requisite tax form, all filled out, the amount of a check to be made out for tax and recording fee, with an envelope addressed to the proper department. Every bit of this information can be found on the web for free.

The buyer then forwarded the deed, a check, and the tax form to the county recording office. He is waiting to get it back, all recorded.

I have done this process once before when buying a resale timeshare. The seller walked me through it, like I did for my buyer.

It was really a very easy process. The buyer liked saving the money that a professional closing would have cost, and it was completely and legally done in very short order.

I just completed a timeshare sale. I used the Timesharing Today kit and prepared the contract between myself and the buyer, and we used Prodox do everything once the contract was signed - you can e-mail them at info@prodox.com and their website is www.prodox.com

They were excellent -- held the funds, prepared documents and the whole thing was under $200.

Cat: I have done the same thing twice myself. I scanned the original deed and edited it with the new information. It took no time at all getting the deed recorded. I must say though, that the State of PA was the best. They returned the deed to me within one week. I was actually shocked. An employee of mine had purchased a PA unit a year ago and had to wait about three months to get his deed.

I do my own deed work as well. Follow the advice of the previous posts. If you do not feel comfortable with this, I can recommend North American Deed, www.fordeeds.com. There fee is about $100.

Just a quick question about doing documents yourself. What do you folks normally do with the funds? That was a big reason why I wanted to use someone like Prodox -- I didn't feel comfortable sending a deed to someone without having received the money and I'm assuming the purchaser would feel the same about sending me money with no deed.

Is it normally money first to seller or deed first to buyer when you do it all yourself?

I had the buyer pay 1/3 earnest money, I then had the deed recorded and he sent the balance when he received the recorded deed. Either you have to have some trust or use a service.

Same with us. We received the deposit and held the deed until final payment. There were no problems. The resale kit from Timesharing Today is the best. You can alter the forms to suit your transaction. It was well worth the money.

Hi, Hajjah!

I'm glad that others have done this, too, and found it to be a fairly easy process. Also glad you concur about the Timesharing Today packet - what a bargain!

About your PA turnaround? I just heard back from the seller this weekend. He sent in the paper on Tuesday (Next Day service) and it was returned to him on Saturday!! Broward County does it fast, depending on work load. If you actually go in and present it, they will do it on the spot for you! Needless to say, the buyer was very pleased.

About the funds, Hajjah's way of a down payment and holding the final deed until payment is pretty standard. You would do the same if you were dealing with a business, or buying from a developer. In our case, since the buyer was trying to get it completed in time for Christmas, he had no objection to sending me the full amount. Like it's been said, there is always an element of trust in any transaction.

If the amount of sale is large, you can use one of the services, or there is one online called iescrow.com.

BTW, let's hear it for TUG ads!! This unit was sold 2 days after posting! Woo-HOO and HOO-ah!!!!!
