We would like to rent a timeshare for a week this summer however we only need it for 4 out of the 7 days. Are we allowed as "renters" to then let friends come and stay for the remainding 3 days. We have no problem leaving our credit card with the resort the whole 7 days and being responsible. Is this something that is allowed?

Buzzy,

You might call the resort anonamously and ask. But make sure you talk to a manager, and get his name.

If its a large resort, probably no one would notice if yu left and others moved in.

If it from a owner they may have it written in the rental contract that you may have to get written permission or other wise you friends cound be legally forced out or not allowed to be checked in.

Most rental contracts will not allow subletting. However, if you're not subletting to your friends and the total number of people that the unit sleeps is greater than the combination of you and your friends, then I don't see any problem with it.

If the resort is small, a change in tenants will likely be noticed. At large places, however, once you are checked in, it is highly unlikely the switch will be noted. Once we had three changes of family and friends during a week at a large resort, and nobody said a word.

I have done this several times. Contact the resort a week or two before your trip and tell them that you will not be able to stay the entire week. However, you have friends traveling with you who will be staying the entire time. Ask to have their name added to the reservation in their computer system.

This also helps if you are having friends meet you at the resort. If their name is added to the reservation, they can pick up a key at the front desk if they arrive before you are while you are out of the room.

As has already been suggested, it depends on your rental contract, which will depend on the source of your rental.

If you are renting from the resort, you only need to deal with the resort's rules. If you are renting from a private party, you have to be concerned more with the person renting to you - legally the decision is theirs. As the owners of the week, they are allowed to rent it to different people for different parts of the week, but that is their decision.

If you are paying for the whole rental, then you are not legally subletting, but the owner does have a say in who can occupy the unit.

The Royal Sands allows this. The owner just has to give the other party written authorization for those days. We did this last Winter with our unit and had no problems, but the Sands seems to be the most flexible resort we have owned at with authorizing others use of your unit as well as keeping good track of it.

My friend left the key with the front desk, and explain that we'd arrive that afternoon to take over the unit at Casa Maya, Cancun. We had no problem. Keep in mind, that the owner still has the responsibility for the unit.

I would put one person from each "group" on the rental contract so that there is always one authorized renter at the resort.
