Excerpt: Vidafel is respected throughout Latin America as the premier developer of vacation clubs and luxury residential communities. It has over 3000 employees and has sold over $50 MILLION worth of timeshare to Americans in Puerto Vallarta and Nuevo Vallarta alone over the years. If they made $50 MILLION just in PV 5 years ago,WHAT can the total $$$ be NOW?

I have the same case as HK, we just got back from Cabo on May 10th, fortunately for us we signed our timeshare contract for a Master Suite on May 9 so we still have a few days to fight back for our full refund. In fact our sales person was John Paul Phillip and we did meet John Fox, we came back $12,150.00 charged to our credit cards plus a $549.00 membership fee. The next day after our arrival, we searched on the internet just to find out that the rentals and re-sell value is much MUCH MORE less! than what we were told. Needless to say my husband and I are very upset about this whole SCAM. On May 11 we sent Hacienda del Mar an e-mail with a read receipt requesting our contract cancellation and cc PROFECO and later on that day we got a read receipt form Hacienda del Mar and today from PROFECO, also PROFECO e-mailed us telling us about their interest in this case and to send them all proper documentation in the next 10 days, which we will, but besides this we are flying tomorrow morning to Cabo to handle this issue personally. So we will keep you posted on what happens with our case, we are not giving up until we get 100% of our money back. VPIP: Logged |

VP,there is power in number. we should fight hacienda del mar till they go down tumbling into the pacific ocean. perhaps there is a way to fight them together to let them know there is more than just one person as he led me to believe and that there is a mass movement to fight them. you may also want to contact mr. sigler at mescam.net who is extremely passionate and well versed in this matter. he has been the source of stregth for the past few days. also, please let me know who your contact at PROFECO was. i have not heard from them yet. neuron@nyc.rr.com IP: Logged |

In the LA Times article that was posted here earlier, it stated that Profeco has many more cases than last year. TUG keeps them busy and the word is going around. I am delighted. Just have patience as they are understaffed. EmmyIP: Logged |

I've had similar problems such as these. I've outlined them on my site at http://www.allenlharris.com/marina-fiesta-resort-evil.html. I built a webpage referencing much of the information posted to this form topic and linked to it, along with my own hard luck story (written quickly only minutes ago). I'm hoping we can help each other out by spreading the word about these timeshares. I'm trying to have my story outrank marina fiesta's home page. The more people that link to my page the easier this will be to achieve. If you have a minute, please take a peak and perhaps someone can help me post links to my page around the internet. Thank you Dave for warning us. Why don't you use this post to switch over to Part II. We need to keep it going for the sake of Newbies and people who have been defrauded at a timeshare presentation anywhere in the world. Emmy

HK, We got back from Cabo (again) and in a nutshell here’s what happened. John Fox refunded our money the same day – no questions asked. We expected a lot of resistance but they were very professional (and surprised that we flew all the way back) about it. John Fox said that they want their owners to be happy and don’t want problems with unhappy customers. We showed the contracts manager your case and he said that you had already been approved for cancellation and actually had your contracts on his desk (He didn’t have to look for them – he picked them right up). After reading about the nightmares others have had with timeshares in general, this was a surprise as they were actually on top of it. He said he would cancel them right away but I suggest keeping in contact with them anyway. He had been there for six years and had never seen anybody fly back to personally cancel. We thought of it as an insurance policy to cancel a $50,000 contract. Although it was really inconvenient, serving the cancellation letter in person within the five day cancellation period would be irrefutable. In our letter we mentioned PROFECO and Article 56 of “Ley Federal de Proteccion al Consumidor” which most others in our situation seem to quote. We also found timeshare specific Federal laws in Mexico. These laws are very deatiled and have teeth. We feel that this is at least equal to if not greater than Article 56 since it defines the rights and obligations of the seller and buyer. It seems that timeshare sellers in Mexico don’t comply with a lot of things listed. We haven’t seen this information posted anywhere else in our research but this will help greatly. Although the entire article is eye opening, reference 6.4.15 in the following Federal “Diario Oficial” “NORMA Oficial Mexicana NOM-029-SCFI-1998, Prácticas comerciales-Requisitos informativos para la comercialización del servicio de tiempo compartido (Cancela a la NOM-029-SCFI-1993).” Since this thread is full we can’t post the translation of the better parts of this “diario” because it’s rather large. We will post more detail on our cancellation letter (written in English and Spanish), legal findings and other items if readers desire on the continuing new thread if it happens. VP
